TERMS AND CONDITIONS
I hereby agree to the following terms and conditions of hire in consideration of being provided selling space at the Darlington Community Markets as a Vendor:
1. The Vendor shall indemnify and hold harmless against any and all loss, damages, liability, claims, suits, costs, fees and expenses whatsoever, regardless of the merit of any claim arising from or in any manner connected to the negligent act or permission of services, work or activities described in this Agreement or the Darlington Community Markets Operational Guidelines:
a. the Darlington Community Markets Committee and its members,
b. the Darlington State School P&C Association and
c. the Darlington State School as representative of Education Queensland
2. The Darlington State School P&C Association will not accept or assume responsibility for any third-party property damage and or personal injury claims arising from the negligence of the Stall Holders or from their activities and or products. Vendors are to carry and maintain their own Public and Products Liability Insurance to protect their liabilities, or may agree to be listed on the Darlington Community Markets’ Public and Products Liability Insurance for a fee as listed on Page 1 of this agreement.
3. If the Vendor agrees that they will be listed on the Darlington Community Markets’ Public and Products Liability Insurance for a fee, the Vendor is solely liable for any charges which may be incurred in the defence of a claim, including but not limited to the excess of the insurance policy, any legal fees which may not be covered by the insurer and any judgement a court may make against the Vendor and/or the Darlington Community Markets.
4. The Vendor agrees to comply with every rule and all procedures and terms set out in the Darlington Community Markets Operational Guidelines following this Agreement contained in Schedule 1.
5. The Vendor acknowledges receipt of a copy of the Darlington Community Markets Operational Guidelines.
6. The Vendor acknowledges that they may be refused permission to participate in a scheduled market on reasonable grounds as determined on a case by case basis at the discretion of the Darlington Community Markets Committee despite having signed this agreement.
7. The Vendor acknowledges that the fees and charges outlined above are payable to the Darlington Markets Committee for each market they are invited to participate in. Fees become payable when the Vendor agrees to attend a market scheduled under Part 5 of Schedule 1.
Schedule 1
Darlington Community Markets Operational Guidelines
1. Preamble
The purpose of the Darlington Community Markets (the Market) is to operate a community market in the Scenic Rim region in accordance with the prevailing laws and regulations of local government for the benefit of the producers and consumers.
The Market acts as a direct marketing outlet for Scenic Rim produce and services. Products are required to be grown, reared, caught, baked, processed, crafted, built or value -added by the vendor. Processed or prepared food products must be made in the Scenic Rim.
Other products and services, including those sourced from outside of the Scenic Rim local government area, may be considered to fill gaps in locally available products and services at the discretion of the Darlington Community Markets Committee. N on-local vendors shall be reviewed prior to each Market and, where all else is equal, preference will be given to Scenic Rim region producers.
The Darlington State School P&C reserves the right to be the sole provider of food and drinks for consumption at the markets. Other stall holders with ‘bulk’ foods that can be purchased and taken home to eat, will be permitted at the discretion of the Market Committee. This policy allows us to keep our stall site fees at a reasonable cost to vendors and helps to ensure the future viability of the market.
Hand-made and crafted items such as furniture, woodcraft, clothing and other quality items produced in the Scenic Rim region, with a preference for, wherever possible, locally sourced raw materials may also be included at the organiser’s discretion. In most instances, products will be required to be evaluated by the Market Committee prior to approval being given.
The following rules apply at the Darlington Community Market:
2. Certificates and Requisites for Participation
All vendors must abide by regulations pertaining to the sale of food as set out by the relevant government departments, particularly health and food safety regulations. A copy of Scenic Rim Regional Council’s required Food Safety Plan is available from the council on request.
Please ensure that you have checked with both the local council and the state food authority if you intend to sell food products at the Darlington Community Market. This is the responsibility of the stall holder/vendor and no liability will be accepted by the Darlington Community Market organisers in this regard.
Resale vendors will be considered at the discretion of the market committee if their product fits into at least 1 category of our overall market guidelines.
3. Organic Producers
Produce that is grown by home gardeners or similar, without chemicals, but is not certified organic will be accepted. Those wishing to sell produce grown in this way must clearly display on their stall that the produce is grown in this manner but is without certification. Any vendor claiming organic produce status must grow the produce in accordance with prevailing organic certification practices and certificates must be displayed on stalls. Organic vendors must also provide the Market Co-ordinator or Market Committee representative with copies of any required documentation pertaining to organic food production.
4. Prices, Labels and Measures
Prices are to be displayed clearly and unambiguously. Pre-pack containers or bottles should be marked with the quantity and weight, the grade, and the name and address of the vendor. Vendors must also list an expiry date on any pre-packed foodstuffs. Compliance with this is the sole responsibility of the vendor and Darlington State School P&C shall not be responsible for ensuring vendors comply with these rules.
‘Any stall holder who chooses to purchase a finished product (relabelling does not alter the product in a way so that it can be sold as handmade) for resale at our market is required to display an A3 sign stating that those items are not handmade by them and they are acting as a distributor. This does not apply to those stall holders selling ON BEHALF OF someone else rather than as a distributor. The market committee retains the right to ask the stall holder to remove the items from sale should they feel that the items in question do not fit with the overall vision of the market.’
5. Dates, Times
The Market Committee will determine the opening and closing dates and times of operation for the Markets. You will be advised via email for the bump in and out procedures.
Stall holders are unable to close their stalls until after the market finish time. This ensures that our market visitors have access to all of our quality stalls for the duration of the market. It also ensures the safety of everyone involved as there are no cars etc entering the grounds during this time.
Vendors are asked to refrain from packing up stalls until after the close of the market. This ensures that our health and safety requirements are followed and also ensures a high presentation level for market visitors.
6. Stall Reservations
Vendors are expected to advise the Market Committee of their attendance or otherwise at the next market. Those who arrive without a prior booking will be allowed to set up if space is available and all other requirements are met.
7. Cancellations
For those who indicate they will be attending the Market but who don’t show without contacting the Market Committee beforehand, the site cost fee will be held as a cancellation fee.
8. Plastic Bag Free Initiative
The Darlington Community Market has chosen to become plastic bag free at point of sale. Vendors are expected to make every effort to provide an alternative to plastic bags. This is a plastic free market and we encourage all vendors to not use plastic bags for the display and sale of goods.
9. Stall Fees
The cost per stall shall be displayed on the stall holder application form. Options to negotiate extra space are available and a cost will be discussed upon request for extra area. Powered stalls will be allocated at the discretion of the Market Committee. An extra cost will be charged to cover costs for powered sites. Vendors will be responsible for ensuring that their equipment complies with the current Queensland Electrical safety regulations and has been tested and tagged where necessary. NO liability for equipment or injury will be accepted on the part on the Darlington State School P&C Association or Darlington State School in this regard.
Stall fees do not include provision of display tables and/or other equipment.
10. Clean Up
Vendors are to ensure their stall sites are left in a clean and tidy condition at the completion
of each market.
11. Stall Spaces
Assignment of spaces is at the discretion of the Market Co-ordinator. The Co-ordinator will respect the seniority of vendors who have a record of co -operation. All things being equal, preference will be given to Scenic Rim region producers.
12. Quality
Growers shall guarantee to offer for sale the highest possible quality food products. If seconds are sold, they are to be marked and priced accordingly. The Market Committee has the authority to ask vendors to remove sub -standard or non-Scenic Rim grown produce from sale.
13. Standards
Vendors are expected to maintain high standards of honesty and to conduct themselves in a courteous, businesslike manner. Rude or abusive behaviour will not be allowed at any time. Customers are expected to maintain the same behaviour.
14. Disputes
Day-to-day problems and disputes are to be resolved by the Market Committee or representative.
The Committee or representative will assure compliance as follows:
• Deliver fair warning for alleged infringements, verbally with a witness present
and then if necessary in writing.
• If the dispute is not resolved, the Committee may recommend suspension of
vendor rights.
15. Insurance
All stallholders are required to maintain a current $10 million Public and Products Liability Insurance Policy whilst trading at the market. It will be necessary for a Certificate of Currency for these policies to be attached to the vendor agreement forms. Should you be unable to negotiate a reasonable rate for insurance, you may wish to be included in the Darlington State School P&C’s Insurance Policy for an additional $30.00 per market. This insurance is only valid for the Darlington Community Markets on arrangement with the Market Committee.
16. Raffles
The Market committee reserves the right to accept or decline requests from interested parties to sell raffle tickets at the Darlington Community Markets. Such requests shall be discussed by the Market Committee on a case by case basis. The Market Committee shall make a final decision solely at their discretion.
17. Other Rules
From time to time, other rules may be instituted to facilitate the smooth operation of the Market. If this occurs, vendors will be notified in advance and in writing. Vendors are taken to have agreed to any further rules instituted if they attend the next market.
18. Twilight Markets
Stallholders are responsible for providing lighting for their stall area to allow for adequate visibility of their products and any hazards which their product or stall equipment may present. Power for lighting of stall sites is not available as this presents a possible tripping hazard with power cords and the like. Lighting for the general market zone will be provided by the Market Committee.
The committee reminds vendors of the following sections of the Darlington Community Markets Operational Guidelines. It is the responsibility of the Vendor to ensure they are adhering to these conditions. Darlington Community Markets committee does not accept responsibility for any issues arising from Vendors who have not followed the correct procedures with regards to the sale of food or produce items and pre-packed foodstuffs.
